Why EB-1A is attractive for tech founders

EB-1A (“extraordinary ability”) is an employment-based first preference category for individuals in the sciences, arts, education, business, or athletics.

For founders, EB-1A is often appealing because:

2) Membership in associations requiring outstanding achievements

Examples: invite-only professional societies or fellowships where admission is based on accomplishments judged by recognized experts.

Tip: paid memberships rarely help unless the criteria are truly selective.

3) Published material about you in major media or trade publications

Examples: profile features in major tech/business outlets; coverage centered on you and your work (not generic company mentions).

Tip: the regulation expects title/date/author and translations if needed.

4) Judging the work of others (individually or on a panel)

Examples: peer review for journals; conference reviewer; hackathon judge; grant judge; formal evaluator for accelerators/incubators.

Tip: document how you were selected and how often you served.

5) Original contributions of major significance (a huge one for founders)

Examples: patents with demonstrated industry uptake; open-source projects with meaningful adoption; widely used technical architectures; standards contributions; measurable impact on the field.

Tip: don’t just prove you built it—prove the field used it (adoption metrics, independent references, downstream products).

6) Authorship of scholarly articles in professional or major media

Examples: peer-reviewed publications; influential technical articles in major outlets; widely cited white papers.

Tip: citations can be powerful at the “final merits” stage, but they shouldn’t be treated as a rigid threshold requirement.

7) Display of work at artistic exhibitions/showcases

Usually not applicable to most tech founders, except certain design/creative-tech contexts.

8) Leading or critical role for distinguished organizations

Examples: founder/CTO in a company with strong reputation; critical role at a recognized lab, unicorn, top-tier accelerator-backed startup, or major tech institution.

Strategy: how to “build” a founder EB-1A case (without forcing it)

1) Define the “field of endeavor” carefully

EB-1A is evaluated against your “field.” Too broad (“technology”) makes “top of field” hard; too narrow can look artificial.

A good field definition for founders is often:
a technical domain + your leadership role + an impact frame
Example: “applied AI for enterprise security,” “cross-border fintech compliance infrastructure,” “computer vision for industrial automation,” etc.

实操策略:如何“搭建”一份 founder EB-1A 案子

1)把“领域”定义好:不要太宽,也不要太窄

把“科技创业者”写成“technology”往往太泛;写得极窄又容易显得生造。
更稳妥的做法是:技术领域 + 你的位置 + 影响范围
例如:企业级安全的应用AI、工业自动化的计算机视觉、跨境合规的金融基础设施等。

2)只挑最强的 3–5 条做深做透,不要撒胡椒面

  • 推荐信像夸夸信。最强的推荐信不是情绪价值,而是可核验事实:你做了什么、为什么重要、谁因此受益、如何验证。
